ORDERING, PRODUCTION, & LEGAL DISCLAIMERS
1. Manufacturing & Order Processing
Bavarian Northwest specializes in custom, made-to-order automotive components. Unlike standard retail inventory, our production cycle is initiated immediately upon order confirmation.

Production Commitment: By placing an order, the Buyer acknowledges that resources, materials, and labor are allocated to their specific build specification instantly.

Irrevocability: Consequently, all orders are considered final and binding at the time of purchase.

Professional Installation Requirement: Due to the complex, technical, and high-performance nature of our custom components, professional installation by a certified, qualified technician is strictly required. Because Bavarian Northwest cannot verify or guarantee the extent of individual mechanical capabilities, tools, or shop practices, proper installation and setup are the sole responsibility of the Buyer.
2. Competition / Off-Road Racing Use Only & California Emissions Disclaimer
WARNING: Unless explicitly specified and accompanied by a California Air Resources Board (CARB) Executive Order (EO) number, all products manufactured, sold, or distributed by Bavarian Northwest are designed, intended, and sold STRICTLY FOR CLOSED-COURSE COMPETITION & OFF-ROAD RACING USE ONLY.

Not for Street or Highway Use: These products are not legal for sale, installation, or use on any pollution-controlled motor vehicle operated on public highways, roads, or streets. Usage on public roads is strictly prohibited by federal Clean Air Act regulations (U.S. EPA) and state laws, including the California Air Resources Board (CARB).

California Health & Safety Code Notice: Under California law (Calif. Health & Safety Code § 39048), a "racing vehicle" is defined strictly as a competition vehicle not driven or operated on public highways. Products sold by Bavarian Northwest for competition use may only be installed on dedicated race cars operated exclusively on closed courses during sanctioned racing events. Competition vehicles may not be driven to or from a racing event on public roads and must be transported via trailer or carrier.

Buyer Assumption of Risk & Liability: The Buyer assumes full, sole responsibility for ensuring that the installation and use of any Bavarian Northwest component complies with all applicable federal, state, and local emissions and vehicle safety laws. Bavarian Northwest assumes no legal or financial liability for fines, penalties, damages, or vehicle failure resulting from improper, non-sanctioned, or street use of our products.
WARRANTY & INSTALLATION
3. Limited Warranty Coverage Schedules
Bavarian Northwest components are engineered for high-performance applications. We warrant our products against manufacturer defects in materials and workmanship under normal operational use from the original date of purchase according to the following category schedules:

Fabricated & Welded Assemblies (2-Year Warranty): Includes turbo kit hot parts, tubular manifolds, downpipes, welded mounting brackets, and all other custom welded products manufactured by Bavarian Northwest.

CNC Machined Components (2-Year Warranty): Includes Dual Catch Can Kits, billet CNC aluminum valve covers, oil filter caps, thermostat plates, and all other billet CNC machined parts.

Bavarian Northwest AN Line Assemblies (2-Year Warranty): Includes custom fuel lines, oil drain/feed lines, coolant lines, and AN plumbing components fabricated by Bavarian Northwest.

Bavarian Northwest Injectors (2-Year Warranty): Applies to all Bavarian Northwest fuel injector sets and related injector hardware.

Pulsar Branded Products (1-Year Limited Warranty): All Pulsar turbochargers, housings, and Pulsar-branded components are covered under a 1-Year Limited Warranty subject to manufacturer evaluation.

Hardware, O-Rings, Seals, & Wear Items (30-Day Warranty): Covers initial material/manufacturing defects upon arrival prior to vehicle operation or fluid exposure.
4. Professional Installation Requirement & Proof
Due to the high-performance and critical nature of custom automotive assemblies, professional installation by a certified automotive technician or qualified performance shop is strongly recommended and, in many cases, strictly required for warranty eligibility.

Proof of Professional Installation: In the event of a warranty claim, Bavarian Northwest reserves the right to request proof of professional installation, including paid invoices detailing shop credentials, date of service, vehicle mileage, and installation scope.

DIY (Do-It-Yourself) Installation Limitations: Damage, failure, or improper function resulting from DIY installation is NOT covered under this warranty. Warranty claims for DIY installations will be denied unless clear, indisputable evidence demonstrates that the component arrived dead-on-arrival (DOA), physically damaged upon receipt, or manufactured out of specification prior to installation.
5. Discretionary Rights & Warranty Voiding
Bavarian Northwest reserves the right to void or deny warranty coverage, at any time and at our sole discretion, under reasons including but not limited to:

Improper Installation & Handling: Over-torqueing threads/fittings, overtightening aluminum fasteners, improper AN hose routing causing abrasion or tension stress, wiring errors, cross-threading, or lack of proper engine tuning.

Misuse & Neglect: Operating components outside of recommended thermal, fluid pressure, or boost limits; exposure to contaminated fluids, improper fuel blends, or severe foreign object debris (FOD).

Unauthorized Modifications: Welding, grinding, cutting, re-machining, or disassembling sealed components without prior written approval from Bavarian Northwest.

Collateral Damage: Secondary failures caused by non-BNW components, engine mechanical failures, or secondary vehicle system breakdowns.
Remedies & Limitations: Bavarian Northwest’s sole obligation under any approved warranty claim is limited strictly to repair, replacement, or store credit for the specific defective item at our discretion. Outbound/return shipping costs, labor charges, vehicle downtime, towing, or secondary damage are strictly non-refundable and unrecoverable under any circumstances.
CANCELLATIONS & RETURNS
6. Cancellation Policy
Due to the custom nature of our inventory, Bavarian Northwest maintains a strict No Cancellation policy.

Discretionary Exceptions: In the rare event that a cancellation request is reviewed and approved by Bavarian Northwest management, such approval is granted solely at our discretion.

Restocking & Admin Fee: Any approved cancellation or modification of an order is strictly subject to a 25% Restocking and Administrative Fee. This fee is non-negotiable and is deducted to cover merchant processing fees, material allocation, and administrative labor already expended.
7. Return Policy (Restricted)
Returns are generally not accepted for custom products.

Authorization Required: No returns or warranty claims will be accepted without prior written Return Merchandise Authorization (RMA) from Bavarian Northwest. Unauthorized shipments will be refused and returned to sender at buyer expense.

Condition & Fees: If a non-warranty return is authorized, the product must be returned in unused, uninstalled, and merchantable condition. All authorized non-warranty returns are subject to the 25% Restocking Fee detailed in Section 6.

Shipping Costs: Outbound and return shipping costs are non-refundable under any circumstances.
SHIPPING, CUSTOMS, & DELIVERY
8. International Shipping, Tariffs, and Customs
For international shipments, Bavarian Northwest operates on a Delivered Duty Unpaid (DDU) basis.

Buyer Responsibility: The Buyer assumes full legal and financial responsibility for all import duties, tariffs, VAT, taxes, brokerage fees, and customs clearance charges levied by the destination country.

Due Diligence: It is the Buyer’s strict obligation to consult with their local customs agency regarding potential costs prior to submitting an order. Bavarian Northwest offers no estimates and accepts no liability for these statutory charges.
9. Refusal of Delivery & Abandonment
The Buyer agrees to accept delivery of the products ordered. Refusal to accept a shipment (due to import fees, change of mind, or otherwise) constitutes a breach of the Terms of Sale.

Transfer of Liability: Upon refusal of delivery, the package is deemed the responsibility of the Buyer. Bavarian Northwest is not liable for the loss, destruction, or condition of refused goods.

Financial Consequence: Bavarian Northwest will NOT issue refunds for refused shipments. The Buyer will be held liable for all cumulative costs, including original shipping charges, return shipping costs, storage fees, and any duties/taxes billed to Bavarian Northwest by the carrier.
